Welcome to Hooks Custom Design Co. By accessing or using this website, submitting artwork, placing an order, or interacting with us online, you agree to be bound by the terms and conditions below ("Terms"). If you do not agree to all of these Terms, please do not use this website or submit an order.

These Terms apply to all visitors, customers, and anyone else who accesses or uses this website.

Your use of this website is also governed by our Privacy Policy, which is incorporated here by reference. Please review our Privacy Policy to understand our practices regarding your personal data.

2. Ownership & Intellectual Property

All content on this website—including images, graphics, text, logos, and branding—is the property of Hooks Custom Design Co. and may not be copied, resold, or used without our express written permission. You retain ownership of any artwork, logos, or files you upload. By uploading content, you grant Hooks Custom Design Co. a limited, non-exclusive right to use, print, and produce the content for the sole purpose of fulfilling your order.

3. User Submissions & Artwork Liability

We are not responsible for verifying the copyright, trademark, or licensing rights of artwork you provide. By submitting a design, you represent and warrant that:

You own the rights OR have obtained the legal permission to use the artwork.

You accept full legal and financial responsibility for any copyright or trademark violations.

Hooks Custom Design Co. is not liable for any claims related to the improper use of images, logos, or designs you have submitted.

You are responsible for ensuring all submitted artwork is print-ready and of sufficient resolution. While we may, as a courtesy, attempt to identify and notify you of low-resolution or poor-quality files, we are not obligated to do so. The responsibility for the final print quality, as it relates to the submitted file, rests entirely with you.

We reserve the right to refuse or cancel any order if we suspect, in our sole discretion, that it violates intellectual property rights (e.g., Disney, NFL, university logos, etc.).

4. Proofs, Approvals & Order Changes

Digital proofs are available upon request. Proofs are required for permanent or high-cost items, such as door vinyl or vehicle graphics. Standard items (e.g., t-shirts, decals) may not include a proof unless requested. Once you approve a digital proof, the design is considered final. The final product will be produced as shown in the approved proof. If you approve a proof, the final product will be considered accepted by you, and no refunds or reprints will be issued unless there is a clear production error on our part (e.g., wrong item, print in the wrong location).

Once a proof is approved, the order moves into production. Changes or cancellations may not be possible.

5. Cancellations & Deposits

Some orders require a deposit. Deposits are non-refundable once materials have been ordered or production has begun.

Cancellation requests are handled on a case-by-case basis. If no work has been done and no materials have been ordered, a refund may be considered at our discretion.

6. Payments

Payments are processed securely through Stripe, Square, or PayPal. All orders must be paid in full before the items are released, unless a separate written agreement (such as an invoice with net terms) exists.

We reserve the right to cancel any order for non-payment or suspected fraud.

7. Refunds, Reprints & Quality Issues

Please refer to our full Refund & Return Policy for complete details. The following is a summary:

We stand by our work. If we make a mistake (e.g., print the wrong design, use the wrong item), we will replace or reprint the affected items.

If the final product matches the proof you approved, no refund or reprint will be issued.

We are not responsible for customer errors, such as:

Typos or grammar mistakes in the approved proof.

Ordering the wrong size or color.

Submitting a low-resolution or poor-quality artwork file.

8. Shipping, Delivery, Pickup & Risk of Loss

Turnaround Times: Turnaround times vary. Standard items average 3–5 business days before shipping. Vehicle wrap and custom graphic timelines will be provided on your estimate.

Shipping: Once an order leaves our facility, shipping carrier delays are outside our control. Tracking is provided for all shipped orders. For all shipped orders, the risk of loss transfers to you upon our delivery of the item to the shipping carrier. We are not responsible for items lost, stolen, or damaged during transit.

Local Pickup: You will be notified when your order is ready for pickup. For orders designated for local pickup, the risk of loss for the items transfers to you upon your pickup of the items from our facility.

9. Prohibited Uses

You are prohibited from using this website or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to submit false or misleading information; (e) to upload or transmit viruses, worms, or any other type of malicious code; or (f) to scrape, data-mine, or otherwise interfere with the functionality of the website.

10. Age Requirements

You must be 18 years of age or older to place an order or submit a design. A minor may only use this site with the express consent and supervision of a parent or legal guardian.

11. Limitation of Liability

To the fullest extent permitted by law, Hooks Custom Design Co. shall not be liable for:

Losses or damages due to incorrect, low-resolution, or non-print-ready artwork files submitted by you.

Any copyright or trademark disputes arising from customer-submitted designs.

Delays caused by shipping carriers or other factors outside our control.

Any indirect, incidental, or consequential damages of any kind.

Our maximum liability for any claim shall not exceed the total cost of the order you placed.

12. Indemnification

You agree to indemnify, defend, and hold harmless Hooks Custom Design Co., its owner, and its employees from any and all claims, liabilities, damages, losses, or costs (including reasonable attorney's fees) arising from or related to: (a) your violation of these Terms; (b) your infringement of any intellectual property or other right of any person or entity; or (c) any claim, loss, or damage resulting from the artwork, logos, or designs you submitted to us.

13. Governing Law & Jurisdiction

These Terms and any dispute arising from your use of this website or your purchase of products shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.

You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Barry County, Michigan, and you irrevocably consent to the jurisdiction of such courts.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. Updated versions will be posted on this page with a revised “Last Updated” date. Your continued use of the website after any such changes constitutes your acceptance of the new Terms.
